Terms of use

These terms, and the licence to use the app, govern your use of Stayed. They are written to be read, and to preserve the rights you hold as a consumer.

1. Acceptance

These Terms, together with the Privacy Policy, govern your use of the Stayed app. By downloading, installing or using Stayed, you agree to them. If you do not agree, do not use the app.

Stayed is operated by Hugo Hodinka, an individual established in Barcelona, Spain.

2. What Stayed is

Stayed is an organisational tool for people who travel. It reads confirmation emails and calendar events you choose to connect, and it helps you keep track of stays, loyalty programmes and the details around them. It is not a booking service, not a travel agent, and not a source of authoritative truth about any hotel, rate, policy or loyalty programme. Where the app shows you something extracted, estimated, or generated, it is telling you what it found, not certifying that the finding is correct. Section 5 sets out what this means in practice, field by field.

3. Licence

Subject to these Terms, Stayed grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own personal, non-commercial use.

You agree not to:

  • copy, modify, or create derivative works of the app, except as Apple’s own App Store terms permit;
  • reverse engineer, decompile, or disassemble the app, except to the extent applicable law prevents this restriction;
  • rent, lease, sublicense, or resell access to the app;
  • use the app to infringe any third party’s rights, including the trade mark and content rights addressed in section 4; or
  • circumvent or interfere with the app’s security, rate limiting, or authentication.

Stayed and its underlying code, design and content (excluding third-party content and third-party marks) belong to Hugo Hodinka or his licensors. Nothing in these Terms transfers ownership of the app to you; you hold a licence to use it, not a copy you own. This licence ends automatically if you breach these Terms, or if you delete the app. Sections that by their nature ought to survive that ending (accuracy disclaimers, limitation of liability, governing law) continue to apply.

4. Trade marks and non-affiliation

Stayed is an independent, personally-run application. It is not affiliated with, endorsed by, sponsored by, or otherwise officially connected with any hotel, hotel group, hotel brand, or hotel loyalty programme referenced, displayed, or made trackable within the app.

All hotel, hotel group, hotel brand and loyalty-programme names, logos and marks that appear in Stayed are the trade marks of their respective owners. They are shown solely so that you can identify and organise your own loyalty memberships, stays and points; their appearance does not imply any business relationship, partnership, licence, sponsorship or endorsement between Stayed and the mark owner, and Stayed claims no right, title or interest in any of these marks beyond what is necessary to identify the programme you have told Stayed you belong to.

5. Accuracy of information

Spanish and EU consumer protection law does not allow a blanket exclusion of liability towards consumers, and nothing in these Terms attempts one. What follows is narrower: Stayed does not warrant the accuracy of information that is extracted from third-party sources, generated by an AI model, or otherwise not independently verified by Stayed, and you should check anything that matters with the hotel or loyalty programme directly before relying on it. Ranked by how much it can cost you if wrong:

  1. Cancellation deadlines and policies. These are extracted by an AI model from your confirmation email or calendar event, with no independent source to check them against. The absence of a deadline shown in the app is not evidence that no deadline exists: it may simply mean nothing was found. Always confirm cancellation terms directly with the hotel or booking site before relying on a date shown in Stayed.
  2. Loyalty tier thresholds and earn rates.These are maintained by hand within the app and can fall out of date as programmes change their terms. They are estimates for planning purposes, not a substitute for your loyalty programme’s own official terms.
  3. Qualifying nights. This figure is presented for your convenience, not as an official count from any loyalty programme. It may include nights booked through channels a programme does not credit, and it cannot include a stay that took place before you installed the app.
  4. Check-in and check-out times.Where a confirmation does not state a time, the app may show a typical time for that type of hotel and country instead of the hotel’s own stated time, and nothing in the app distinguishes an inferred typical time from a time the hotel actually confirmed. Always check the time shown against your confirmation, or with the hotel directly.
  5. Area guides and the concierge chat. These are generated by an AI model and are not checked against any mapping, business-listing or places database. Treat suggestions as a starting point for your own judgement, not as a verified recommendation.
  6. Access PIN, meal plan, phone number, amenities and rating. These may come from your confirmation, from a third-party data source, or from an estimate, and the app does not distinguish between them when it displays them. Confirm anything that matters with the property before you travel.

6. Subscriptions and purchases

Stayed offers optional paid features (Pro) on a subscription or one-time basis. Current pricing is shown in the app; nothing in these Terms sets, discounts, or otherwise changes that pricing.

  • Merchant of record.Purchases are processed by Apple as merchant of record for in-app purchases, not by Hugo Hodinka directly. Your purchase is therefore also subject to Apple’s own Media Services Terms and Conditions. Nothing in these Terms is intended to exclude or reduce any right Apple’s own terms give you.
  • VAT-inclusive pricing. Displayed prices include applicable VAT.
  • Auto-renewal and cancellation.Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Cancellation is managed entirely through your Apple ID’s subscription settings, not within Stayed itself and not by contacting Stayed directly.
  • Refunds.Refund requests are handled by Apple under Apple’s own refund process, not by Stayed directly. If you believe you are entitled to a refund, request it through Apple.
  • Right of withdrawal.Under EU consumer law, you ordinarily have 14 days to withdraw from an online purchase without giving a reason. For digital content supplied immediately, this right is typically waived once you expressly consent to immediate performance and acknowledge you lose the withdrawal right by doing so. Where Apple’s own purchase flow captures this consent, these Terms rely on that flow having done so.
  • Price changes. Stayed will not apply a price increase to an existing subscriber without advance notice and without the right to cancel before the new price takes effect. This does not affect the price on a new purchase or a differently priced tier.
  • Lifetime purchases. Where a one-time purchase is described as lasting for the lifetime of the product, lifetime means the lifetime of the Stayed app and service, not the lifetime of you as an individual user. In line with the EU Digital Content Directive, this carries a commitment to provide updates for the period a consumer may reasonably expect a digital product described this way to keep working, not an unconditional promise that the app or service will exist, or continue to be updated, forever.
  • If your subscription lapses. Your address and anything Stayed has already found for you are kept; only active forwarding and syncing pause. Reconnecting or resubscribing resumes them.

7. Apple App Store

Stayed is distributed through the Apple App Store. Because these Terms include Stayed’s own end user licence agreement rather than relying on Apple’s standard licence, the following terms apply between you, the developer and Apple.

  • These Terms are concluded between you and Hugo Hodinka (the developer) only, and not with Apple. The developer, not Apple, is solely responsible for Stayed and its content.
  • Your licence to use Stayed is limited to use on any Apple-branded device that you own or control, and as permitted by the Usage Rules set out in Apple’s Media Services Terms and Conditions.
  • Apple has no obligation whatsoever to provide any maintenance or support services for Stayed.
  • In the event of any failure of Stayed to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Stayed, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the developer’s responsibility.
  • The developer, not Apple, is responsible for addressing any claims by you or a third party relating to Stayed or your use of it, including product liability claims, any claim that Stayed fails to meet a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
  • In the event of a third-party claim that Stayed, or your possession and use of it, infringes that third party’s intellectual property rights, the developer, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
  • You represent and warrant that you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a terrorist-supporting country, and that you are not listed on any US Government list of prohibited or restricted parties.
  • Any questions, complaints or claims regarding Stayed should be directed to the developer, Hugo Hodinka, Barcelona, Spain, at hello@stayed.info.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

8. Minimum age

Stayed’s paid tier is intended for users aged 18 and over. Spain’s data protection law (LOPDGDD Article 7) sets the age of digital consent at 14, but general civil law limits a minor’s capacity to enter into a paid contract, and Stayed’s Pro tier is a paid subscription. Stayed is not directed at children, and no part of the app is designed to appeal specifically to a child audience.

9. Limitation of liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot lawfully be excluded or limited under Spanish or EU consumer protection law. Nothing in these Terms is intended to deprive you of any statutory right you hold as a consumer.

Subject to that, and to the fullest extent the law allows: Stayed is provided as an organisational tool, and information within it, particularly the categories described in section 5, is provided without warranty as to its accuracy, completeness, or currency. Hugo Hodinka is not liable for losses arising from a decision made in reliance on information later found to be inaccurate, where that information was clearly of the kind described in section 5 and a reasonably careful user would have been expected to verify it before relying on it for something consequential (a missed cancellation deadline, a mistimed check-in, or similar).

10. Governing law and disputes

These Terms are governed by the law of Spain. If you are a consumer habitually resident in another EU member state, mandatory consumer-protection provisions of that state’s law continue to apply to you regardless of this clause, and this clause does not deprive you of them.

If you are a consumer and we cannot resolve a dispute directly, you may bring it to the Spanish consumer arbitration system (Sistema Arbitral de Consumo) or to the competent regional consumer authority. You can always contact us first at hello@stayed.info, and we will try to put things right.

11. Changes to these Terms and the service

Stayed is a living app, and its features may change or be withdrawn over time. Where we make a material change to a paid feature, we will give notice and, where the law requires it, a right to cancel, consistent with the lifetime and Digital Content Directive wording in section 6.

We may also update these Terms as Stayed changes or the law requires. When we do, we will change the date at the top of this page, and where a change materially affects your rights we will surface it in the app. Continued use of Stayed after an update means the current version applies to you.
